Nouvelle demande de suppression en masse du même contributeur "zélé"

Je ne suis pas le seul concerné. Le même contributeur entend procéder de même sans nuance, avec les photos sous PD-Italy : https://commons.wikimedia.org/wiki/Commons:Deletion_requests/Files_uploaded_by_Cats%27_photos
Il regroupe des photos ayant des caractéristiques bien différentes en se basant encore une fois sous des principes généraux au lieu de les étudier au cas par cas.
Ce contributeur fait aussi jouer le critère URAA contre le PD-Italy. Il faudrait prévenir https://commons.wikimedia.org/wiki/User:Krd d'être moins rapide pour ce type de requêtes avant de les supprimer. Exemple :

Tout ça est assez surprenant pour un très récent contributeur, qui n'est inscrit sur Commons que depuis février 2023 (y compris sur es.wikipedia à la même période). Au vu de ses contributions, sa grande maîtrise des usages WP et sa démarche systématique de suppression, ne pourrait-on pas considérer qu'il s'agit d'une certaine "désorganisation" et d'une relative "wikitraque" ? - Il insiste aussi concernant une photo de Pierre Repp (travail collectif de 1953) sans démontrer que ma ref qui précise bien que cette photo date bien d'avant 1954, ne serait pas valable (livre) :

URAA
[edit]Hi Ruthven, recently you closed Commons:Deletion requests/File:PierreRepp-1953.png with the rationale per Tisourcier and that was based on Commons:Massive restoration of deleted images by the URAA and citing you: As Ruthven explained allready, URAA can't be the sole motive for deletion. I already pointed this out on Commons:Deletion requests/File:Berger-Gall-Italie-1984.png, but as I haven't pinged you, so maybe it didn't reach you. Namely:
- The decision Commons:Massive restoration of deleted images by the URAA from 2014 was invalidated shortly after, and that is clear from the note from @Clindberg: : the above conclusion was superseded by Commons:Review of Precautionary principle; current policy is at Commons:Licensing#Uruguay_Round_Agreements_Act.
- The resolution Commons:Review of Precautionary principle, also from 2014, resolved that COM:PCP cannot be ignored for URAA-related cases.
- The template {{Not-PD-US-URAA}} and its documentation states This template should NOT be applied to files uploaded after 1 March 2012. Files uploaded after this date which the template would apply to should be treated as other violations of the Commons:Licensing policy are.
- The March 1, 2012 date is when the US Supreme court rules that URAA restoration was constitutional, see en:W:Golan v. Holder. The tag was a compromise to avoid mass deleting suspicious files. The evaluation of URAA-related cases is complex as one needs to use the legislation available in 1996. In France, for example, the copyright duration was 50 years instead of 70 years.
- The current policy Commons:Licensing#Uruguay_Round_Agreements_Act states: A mere allegation that the URAA applies to a file cannot be the sole reason for deletion. If the end result of copyright evaluation is that there is significant doubt about the freedom of a file under US or local law, the file must be deleted in line with the precautionary principle.
Notice that the DR was not a mere allegation, because:
- We know it was published poster in France in 1953 according to a book cited by Tisourcier (I have no access to it), and as the cover of an EP also published in France in 1955 (see the source on the file).
- We know that the copyright duration in France in 1996 was 50 years ppd for anonymous works. Thus, if it was first published in 1953, it was copyrighted in France in 1996 and it was supposed to enter in the pubic domain in 2004, but it was subsequently extended and it finally eentered to the French public domain this year.
- There is little evidence that a poster of a French actor, unknown to the US public, was simultaneously published in the US.
If you ignored or were unaware of some of the previous points, I would ask you to reconsider your resolution on the DR. Otherwise, I would appreciate if you provide a reason as to why it is in the US public domain as required by COM:L. Thanks. Günther Frager (talk) 18:48, 22 July 2024 (UTC)

- @AbchyZa22 Es un tema delicado. Los logos de los partidos no son públicos, y las fotos tampoco. Sim embargo, el tarjetón electoral ha sido publicado con fondos publicos. Hay que ver como los partidos han autorizado el uso de los logos y las fotos. Ruthven (msg) 15:14, 1 August 2024 (UTC)
